In a large number of cases, we find that both those liable to pay maintenance and those entitled to receive it provide false information regarding their income. Payslips are falsified, second jobs are concealed and not declared for tax purposes, promotions and salary increases are omitted. Through surveillance of the suspect or suspects, covert secondary employment can be proven; furthermore, in-depth research and covert interviews, for example with colleagues, provide concrete information about the actual income of the other party.
This of course does not only concern direct claims between former partners, such as separation maintenance and post-marital maintenance, but also child maintenance. While the payer – in our professional experience almost always the father (see gender ratio) – often shows significant discrepancies between “official” and actual income, recipients – the child or its legal representative – may on occasion interpret the maintenance arrangements as generously as possible by concealing the child’s income, for example in the form of training remuneration relevant to maintenance or a student job.
