An unapproved secondary occupation not only carries the risk of the employee becoming overworked, but also frequently the danger that the worker maintains contacts with competitors that could harm the primary employer. Our IHK-certified commercial investigators from Kurtz Investigations Halle provide court-admissible evidence of additional gainful employment: +49 345 2194 0000.
As a rule, people cannot work 60 hours a week without eventually breaking down, and thus the signs of double employment are often impossible to overlook: The employee is overtired, unfocused, bad-tempered and/or gives the impression of being constantly under extreme pressure. Some try to counter these effects by resorting to stimulants/drugs that are meant to help them manage both jobs simultaneously. It goes without saying that this cannot work in the long term and almost inevitably leads to serious health damage, which in turn affects work performance. The dual burden of a secondary job therefore has a detrimental effect on business operations, which is why many employers generally refuse to grant their staff permission for a second job. Employees who may be financially dependent on additional work (for example due to substantial maintenance obligations) often conceal the extra employment from the main employer as well as from social insurance providers and tax authorities. The latter even categorises the second job as undeclared work and thus as a criminal offence (§ 266a StGB and the Act to Combat Undeclared Work (SchwarzArbG)).
Our investigators from Halle/Saale are trained and experienced in both employee surveillance and the provision of court-admissible evidence. After completing the investigation, our clients receive a written report that enables them to hold the employee in question accountable under employment law. We will gladly support your company as well. Please send us an email with a description of the circumstances to kontakt@detektei-kurtz.de or call us for a non-binding consultation.
Particularly delicate and at the same time very common are secondary occupations for the direct competitors of the primary employer, as clear conflicts of interest exist here. Employment with a competitor always carries the risk of intentional or accidental disclosure of company secrets. Moreover, the employee uses the skills and experience gained over years with their employer for the benefit of the competitor – meaning the primary employer is harmed twice over.
Through discreet surveillance of the suspect employee and, in some cases, through undercover interviews with the employing companies, Kurtz Detective Agency Halle – responsible for Magdeburg, Dessau-Rosslau and the whole of Saxony-Anhalt – is able to provide clients with a comprehensive overview of their employee’s actual activities.
